These Terms and Conditions govern the purchase and use of the products and services provided by 357 Tecnologia Ltda., under the Digilink brand. By purchasing, activating or using any Digilink service, the customer declares that they agree to the conditions below.
1. Services offered
Digilink provides technology and cloud infrastructure solutions, including, among others:
- cloud servers and managed infrastructure;
- website and application hosting;
- business e-mail;
- cloud storage and file servers;
- cloud backup;
- antivirus, security and endpoint protection;
- firewall, VPN, monitoring and related services;
- additional services, licenses and custom solutions.
The characteristics, resources, limits, prices and features of each service are those stated on the product page, commercial proposal, order or contract in force.
Some products may use third-party technologies, software or licenses, and are also subject to the technical and licensing terms of the respective manufacturers.
2. Registration and activation
Activation takes place after payment confirmation, registration approval or contract signature, depending on the product purchased.
The customer must provide truthful information and keep their registration data, e-mail address and phone number up to date.
Digilink may request confirmation of identity, ownership or additional information whenever necessary for security, fraud prevention or legal compliance.
3. Proper use of the services
The services must be used exclusively for lawful purposes.
Using the Digilink infrastructure for the following is prohibited:
- sending SPAM or unauthorized messages;
- phishing, fraud or spreading malware;
- attacks, intrusions, port scanning, brute force or DDoS;
- infringement of copyrights, trademarks or intellectual property;
- hosting or distributing illegal content;
- activities that compromise the security, stability or reputation of the network;
- abusive or deliberate consumption of resources that harms other users or the infrastructure.
Digilink may block traffic, suspend or cancel services when it identifies a security risk, abuse, fraud or violation of these Terms.
4. Plan resources and limits
Each plan has its own limits on storage, processing, memory, users, devices, mailboxes, traffic, retention or other characteristics indicated at the time of purchase.
The customer may not permanently exceed the contracted resources. When necessary, Digilink may request an upgrade, temporarily limit resources or propose adjustments to the environment.
For services with reserved or dedicated resources, the contracted limits will be applied according to the technical architecture used.
5. Servers, hosting and applications
For managed services, Digilink administers the components expressly included in the contracted plan.
The customer remains responsible for the systems, applications, databases, content and configurations under their administration, unless a specific management service has been contracted.
Third-party software, plugins, scripts or applications may present failures, vulnerabilities or incompatibilities regardless of the Digilink infrastructure.
Digilink may apply security measures, emergency updates, port blocking or access restrictions when there is a risk to the infrastructure or to third parties.
6. Business e-mail
The e-mail service is subject to responsible use and abuse protection policies.
Using Digilink accounts to send SPAM, to mail purchased lists without consent or to send bulk mailings that may harm the reputation of the servers and IP addresses is prohibited.
Messages may be blocked or classified by antispam and antivirus systems.
Message delivery also depends on external factors, such as reputation, destination servers, third-party filters and the policies of external providers, so it is not possible to guarantee delivery of 100% of the messages sent.
7. Backup and storage
When the contracted plan includes backup, the frequency, capacity and retention period stated in the product description will apply.
For example, Digilink Cloud servers currently include a daily FULL backup with 7-day retention.
For dedicated backup products, the capacity, number of devices and other limits follow the plan purchased.
Although Digilink takes measures to ensure the integrity of the copies, no backup system is absolutely immune to failures. For critical data, the customer is advised to maintain an additional redundancy strategy appropriate to their operations.
After a service is canceled, the data may be permanently deleted once the applicable operational period has elapsed.
8. Antivirus and third-party software
Antivirus, security, backup and other software services licensed by third parties depend on the technologies of the respective manufacturers.
Digilink acts in the provision, activation, support and/or management of these services according to the product purchased, but does not guarantee that any security solution is capable of preventing 100% of existing threats.
Licenses may be suspended or terminated when the associated service is canceled or becomes delinquent.
9. Security and credentials
The customer is responsible for safeguarding their passwords, keys, administrative access and other credentials.
The customer must use strong passwords and additional authentication when available, and keep their equipment and applications up to date.
Digilink will never be responsible for access carried out with valid credentials that have been shared, leaked or compromised through the fault of the customer or of third parties outside its infrastructure.
10. Payments, renewal and delinquency
The amounts, billing frequency and payment terms are those presented at the time of purchase or in the commercial proposal.
Plans purchased on a recurring basis may be renewed automatically until the customer requests cancellation.
In the event of non-payment, Digilink may suspend the services after notifying the customer.
If non-payment persists, the services may be canceled and the associated data deleted.
Prices may be adjusted periodically in accordance with the contract, commercial conditions or previously disclosed indices.
11. Cancellation and refunds
The customer may request cancellation through Digilink's official channels.
For business or custom contracts, the term, minimum commitment or prior notice conditions set out in the respective proposal or contract prevail.
For online purchases to which consumer protection legislation applies, the rights provided by law will be respected, including the right of withdrawal where applicable. The Código de Defesa do Consumidor (Brazilian Consumer Protection Code) provides a 7-day period for certain purchases made outside the commercial establishment.
Amounts relating to services already used, activated licenses, consumed resources or custom services may follow specific conditions disclosed at the time of purchase, in compliance with applicable legislation.
12. Availability and maintenance
Digilink adopts technical measures to keep its services available and stable, and may perform preventive, corrective or emergency maintenance.
Unavailability may occur as a result of:
- failures of carriers or external suppliers;
- cyberattacks;
- maintenance;
- power or external infrastructure failures;
- problems with third-party software or applications;
- configurations made by the customer;
- force majeure events.
Where there is a specific SLA, the conditions of the corresponding plan or contract will prevail.
13. Technical support
Support will be provided through the channels made available by Digilink, including e-mail, customer panel, phone and WhatsApp, depending on the product purchased.
Support covers the components administered by Digilink. System development, application fixes, configuration of external software or activities outside the scope may be charged separately.
14. Data protection and privacy
Digilink processes personal data in accordance with Brazilian legislation and its Privacy Policy.
For services in which Digilink only stores or processes information on behalf of the customer, the responsibilities of controller and processor will apply according to the nature of the processing and the LGPD (Brazilian General Data Protection Law).
Data may be provided to authorities when there is a legal obligation or a valid order, within the limits of applicable legislation.
The retention and disclosure of records will also comply with the Marco Civil da Internet (Brazilian Internet Civil Rights Framework) and other applicable regulations.
15. Limitation of liability
Digilink employs good practices for security, availability and continuity, but no technology service is entirely immune to failures.
Digilink will not be liable for lost profits, loss of opportunities, indirect damages or failures arising from systems, applications, carriers, external services or actions under the customer's responsibility, except in cases where applicable legislation establishes a different liability.
Critical operations must have appropriate redundancy, contingency and recovery strategies.
16. Communications
Communications may take place by e-mail, WhatsApp, customer panel or other electronic means provided in the registration.
The customer is responsible for keeping their contact details up to date.
17. Changes to the Terms
These Terms may be updated to reflect changes in products, legislation, technologies or operational policies.
Relevant changes will be made available on this page and, when necessary, communicated to the customer.
18. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil.
The courts of the Comarca de Belo Horizonte/MG are chosen to settle any disputes, except in cases where the law establishes a different jurisdiction.
